Terms & Conditions
Effective Date: July 21,, 2026
These Coaching Services Terms and Conditions (“Coaching Terms”) govern all golf instruction, private coaching, Swing Lab sessions, coaching packages, evaluations, analyses, practice recommendations, and related instructional services provided by The Swing Refinery LLC (“TSR,” “we,” “us,” or “our”).
The individual purchasing, scheduling, or participating in coaching services is referred to as the “Client” or “Participant.” When the Participant is a minor, “Client” also includes the parent or legal guardian purchasing or authorizing the services.
By purchasing, scheduling, or participating in any coaching service, the Client acknowledges that the Client has read, understands, and agrees to these Coaching Terms.
1. COACHING SERVICES
TSR may provide services including, but not limited to:

Private golf instruction;
-
Swing Lab analysis;
-
TrackMan data collection and interpretation;
-
Golf swing video recording and review;
-
Ball-flight, club-delivery, strike-location, and movement-pattern analysis;
-
Practice recommendations and drills;
-
Equipment-related observations;
-
Follow-up reports, video clips, and instructional communications; and
-
Other golf coaching, evaluation, or instructional services offered by TSR.

The scope and content of each session will be determined by the coach based on the service purchased, the Client’s goals, the Client’s physical capabilities, the Client’s current swing patterns, available session time, and the coach’s professional judgment.
Coaching recommendations reflect observations made during the applicable session. Recommendations may change as the Client’s swing, physical condition, equipment, goals, skill level, or practice habits change.
2. SWING LAB SERVICES AND DELIVERABLES
A Swing Lab session is a structured golf swing evaluation and testing experience. It may include TrackMan iO data, dual-camera swing video, ball-flight evaluation, movement and impact-pattern analysis, testing of potential adjustments, and related professional interpretation.
Each completed Swing Lab session includes:

A written or electronic Swing Lab report;
-
Selected swing-video clips; and
-
Practice recommendations or drills.
Deliverables will be prepared following the session and transmitted electronically using the email address or other contact information supplied by the Client.
The specific length, format, number of images or clips, amount of data, and level of detail included in a report may vary based on the circumstances of the session and the coach’s professional judgment. Raw camera footage, complete TrackMan files, internal coaching notes, or every recorded swing are not included unless TSR expressly agrees otherwise in writing.
A Swing Lab session is not represented as a complete or permanent diagnosis of every aspect of a Client’s golf swing. It is intended to identify and interpret the patterns determined by the coach to be most relevant during the session and to provide the Client with a practical path forward.
3. SCHEDULING
Coaching sessions are available by appointment only and are subject to instructor and facility availability.
A session is not confirmed until the required purchase or payment has been completed and an appointment has been successfully scheduled through TSR’s designated scheduling system or otherwise confirmed by TSR.
The Client is responsible for verifying the scheduled date, start time, service type, and location.
TSR is not responsible for a missed appointment caused by the Client’s failure to review a booking confirmation, reminder, calendar entry, email, text message, or other scheduling communication.
4. ARRIVAL AND LATE ARRIVALS
Clients should arrive sufficiently early to be ready to begin at the scheduled start time.
Coaching sessions begin and end at their scheduled times. A Client who arrives late will receive only the remaining portion of the scheduled session.
A late arrival does not entitle the Client to:
-
An extension of the session;
-
A partial refund;
-
A credit;
-
A prorated price reduction; or
-
Additional instructional time at a later date.
TSR may extend a session in its sole discretion if scheduling and facility availability permit, but TSR is not obligated to do so.
If a Client arrives so late that the coach reasonably determines that the purchased service cannot be meaningfully or safely completed in the remaining time, TSR may treat the appointment as a late cancellation or no-show.
5. CLIENT CANCELLATIONS AND RESCHEDULING
The Client must provide at least twenty-four (24) hours’ notice to cancel or request rescheduling of a coaching appointment.
Notice must be provided through a communication method designated or accepted by TSR. The Client is responsible for obtaining or retaining confirmation that the cancellation or rescheduling request was received.
When at least twenty-four hours’ notice is provided, TSR will permit the Client to reschedule the session, subject to availability and any expiration period applicable to the purchase or package.
Except where TSR expressly agrees otherwise in writing, cancellation of an appointment does not create a right to a cash refund. The payment will remain associated with the eligible coaching service or package.
Requests received fewer than twenty-four hours before the scheduled start time are considered late cancellations and are subject to forfeiture of the session and all amounts paid for that session.
6. NO-SHOWS
A Client who does not attend a scheduled appointment and has not provided timely notice will be considered a no-show.
A no-show results in forfeiture of:
-
The scheduled session;
-
Any session credit applied to the appointment; and
-
All amounts paid or allocated to that session.
A forfeited session will not be replaced, credited, or refunded except at TSR’s sole discretion.
Repeated no-shows or late cancellations may result in TSR declining to accept future coaching appointments or requiring additional prepayment or booking conditions.
7. WEATHER AND TRAVEL CONDITIONS
Because weather and travel conditions can vary materially based on location, distance traveled, road conditions, official advisories, and other circumstances, weather-related cancellation and rescheduling requests will be evaluated individually.
TSR may consider factors including:

The Client’s travel distance;
-
Actual road and weather conditions;
-
Government or emergency travel advisories;
-
Facility accessibility;
-
The timing and severity of the weather event; and
-
Whether the Client contacted TSR as promptly as reasonably possible.
Any waiver of the cancellation policy or permission to reschedule because of weather is made at TSR’s sole discretion.
A discretionary exception made for one Client or one weather event does not require TSR to make the same exception in another circumstance and does not modify the general cancellation policy.
If TSR determines that the facility should close or that the coach cannot safely conduct the session, TSR will reschedule the affected appointment or issue an appropriate coaching credit.
8. CANCELLATION OR INTERRUPTION BY TSR
TSR may cancel, shorten, interrupt, or reschedule a session because of:

Coach illness or unavailability;
-
Equipment or simulator malfunction;
-
Utility, internet, or technology interruption;
-
Facility closure;
-
Hazardous weather;
-
Safety concerns;
-
Emergency conditions;
-
Acts of government;
-
Events beyond TSR’s reasonable control; or
-
Any circumstance that TSR determines prevents the service from being performed safely or appropriately.
When TSR cancels a session before it begins, the Client’s remedy will generally be rescheduling or a credit for the affected service.
When a session is materially interrupted for reasons not caused by the Client, TSR will determine in good faith whether an additional session, partial replacement session, credit, or other accommodation is appropriate.
TSR is not responsible for travel expenses, lost wages, childcare costs, lodging, consequential losses, or other incidental expenses resulting from a cancellation, delay, interruption, or rescheduling.
9. COACHING PACKAGES
When the Client purchases a multi-session package:
-
The package may be used only for the service or services identified at purchase;
-
Sessions must be scheduled in accordance with TSR’s booking procedures;
-
Each late-canceled or missed appointment will be deducted from the package;
-
Packages may not be shared or transferred without TSR’s prior written approval;
-
Packages have no cash value;
-
Unused sessions are not redeemable for cash; and
-
Any stated expiration date or use period will apply.
A Client’s failure to schedule or use all sessions within an applicable use period does not create a right to a refund, extension, or substitute service.
TSR may grant an extension because of documented medical hardship, extraordinary circumstances, or other compelling reasons, but any extension is solely within TSR’s discretion.
10. CLIENT HEALTH, PHYSICAL READINESS, AND DISCLOSURE
Golf instruction involves physical movement, repetitive swinging, rotation, bending, weight transfer, balance, physical exertion, and the use of golf clubs and balls.
The Client represents that the Client is physically capable of participating safely or has obtained any medical clearance reasonably necessary for participation.
Before and during a session, the Client must promptly inform the coach of any condition that may affect safe participation, including:

Current or prior injuries;
-
Pain or discomfort;
-
Joint or mobility limitations;
-
Balance concerns;
-
Cardiovascular concerns;
-
Recent surgery;
-
Pregnancy-related restrictions;
-
Neurological conditions;
-
Medication-related limitations; or
-
Any medical instruction restricting physical activity.
The Client must immediately stop and inform the coach if the Client experiences pain, dizziness, faintness, unusual shortness of breath, chest discomfort, loss of balance, weakness, numbness, or any other concerning symptom.
The coach may modify, pause, or end a session if the coach believes continued participation may be unsafe. Such a decision is a safety judgment and does not, by itself, entitle the Client to a refund.
11. NO MEDICAL, THERAPEUTIC, OR REHABILITATIVE SERVICES
TSR and its golf coaches do not provide medical advice, medical diagnosis, physical therapy, occupational therapy, chiropractic treatment, athletic training, rehabilitation, nutritional treatment, or mental-health services through ordinary golf coaching.
Any discussion of mobility, discomfort, physical movement, fitness, or body mechanics is offered solely in connection with golf instruction and is not a substitute for evaluation or treatment by an appropriately licensed healthcare professional.
The Client should consult a qualified healthcare professional before beginning or continuing golf instruction if the Client has an injury, medical condition, unexplained pain, or concern regarding physical readiness.
A coach’s willingness to modify an exercise, drill, or swing movement does not constitute medical clearance or a determination that participation is medically appropriate.
12. ASSUMPTION OF RISK AND GENERAL LIABILITY WAIVER
Golf coaching and Swing Lab services involve risks associated with physical exertion, repetitive movement, rapid swinging of golf clubs, struck or errant golf balls, impact with equipment or surfaces, loss of balance, slips, falls, muscle or joint strain, aggravation of pre-existing conditions, equipment malfunction, and the conduct of other persons.
The Client acknowledges that participation is voluntary and may result in injury, property damage, or other loss.
All coaching services are additionally subject to TSR’s then-current Hold Harmless & Assumption of Risk Waiver and Release of Liability Agreement (“General Waiver”).
The General Waiver is incorporated into these Coaching Terms by reference as though fully stated herein. These Coaching Terms supplement the General Waiver and do not replace, narrow, or supersede it.
If a direct conflict exists between these Coaching Terms and the General Waiver regarding bodily injury, property damage, assumption of risk, release, indemnification, emergency treatment, facility conduct, or use of TSR premises or equipment, the provision affording TSR the greatest lawful protection will apply to the fullest extent permitted by law.
Nothing in these Coaching Terms is intended to waive a right or exclude liability that cannot lawfully be waived or excluded.
13. CLIENT CONDUCT AND SAFETY INSTRUCTIONS
The Client agrees to:
-
Follow all coach instructions and facility rules;
-
Use clubs, balls, training aids, cameras, simulator equipment, and other property only as instructed;
-
Remain alert to surrounding persons and equipment;
-
Swing only in an area designated by the coach;
-
Avoid swinging while another person is within the swing area;
-
Refrain from horseplay, reckless conduct, or intentional misuse of equipment;
-
Avoid participation while impaired by alcohol, cannabis, illegal drugs, medication, extreme fatigue, or another condition that compromises safety; and
-
Promptly report unsafe conditions, equipment damage, or injuries.
The Client remains responsible for exercising reasonable judgment and for declining any movement or activity the Client does not believe can be performed safely.
14. NO GUARANTEE OF RESULTS
Golf performance and improvement depend on numerous factors outside TSR’s control, including:
-
The Client’s physical ability and limitations;
-
Athletic history;
-
Skill level;
-
Practice frequency and quality;
-
Willingness and ability to implement recommendations;
-
Equipment characteristics and suitability;
-
Course conditions;
-
Mental and emotional factors;
-
Injury, fatigue, or health conditions;
-
Changes in technique over time; and
-
The inherent variability of golf performance.
TSR does not promise or guarantee:
-
A particular swing change;
-
Elimination of a miss pattern;
-
Increased clubhead speed or ball speed;
-
Increased distance;
-
Improved accuracy or consistency;
-
A lower handicap or scoring average;
-
Tournament success;
-
Selection for a team;
-
Prevention of injury;
-
A particular practice or performance timeline; or
-
Any other specific outcome.
Data, observations, drills, opinions, and recommendations are educational and instructional tools. They are not guarantees of future performance.
The Client understands that a recommended change may temporarily affect comfort, consistency, ball flight, or scoring while the Client is learning and adapting.
15. EQUIPMENT AND CLUB OBSERVATIONS
The Client is responsible for the selection, maintenance, condition, transportation, and safekeeping of the Client’s clubs, devices, clothing, and personal property.
TSR may make general observations concerning club characteristics, setup, fit, or performance. Unless expressly provided as part of a separate professional club-fitting service, such observations are instructional opinions and are not represented as a comprehensive club fitting or guarantee that particular equipment will improve performance.
The Client should inspect personal equipment regularly and disclose any known defect or damage before it is used during a session.
TSR is not responsible for ordinary wear, latent defects, pre-existing damage, manufacturer defects, or failure of Client-owned equipment, except to the extent liability cannot lawfully be excluded.
16. VIDEO RECORDING, DATA COLLECTION, AND INSTRUCTIONAL USE
The Client authorizes TSR to photograph and record the Client’s golf swing, movement, setup, ball flight, impact conditions, voice, and instructional interactions as reasonably necessary to provide coaching services.
The Client further authorizes TSR to:

Collect and retain TrackMan and related performance data;
-
Review recordings during and after the session;
-
Create still images, annotations, comparisons, excerpts, or clips;
-
Use recordings and data internally for analysis, coaching preparation, quality control, follow-up instruction, and documentation;
-
Store recordings, reports, and related materials using TSR’s systems or third-party technology providers; and
-
Deliver selected recordings, reports, or recommendations electronically to the Client.
TSR may retain or delete coaching recordings, data, reports, and internal notes in accordance with its operational practices. Unless required by law or expressly agreed in writing, TSR is not obligated to preserve raw footage, raw data, or coaching files for any particular length of time.
The Client should download and retain any report, clip, or other deliverable the Client wishes to preserve.
Marketing Use
Permission to record or use materials for coaching and internal business purposes does not automatically authorize TSR to publish the Client’s identifiable image, voice, name, testimonial, or swing footage in advertising, social media, promotional materials, or public-facing content.
TSR will obtain separate permission before using identifiable coaching footage or images for marketing, except where the Client cannot reasonably be identified or the use is otherwise permitted by law.
17. PRIVACY AND ELECTRONIC COMMUNICATIONS
The Client consents to receiving coaching-related communications electronically, including:
-
Appointment confirmations and reminders;
-
Swing Lab reports;
-
Swing videos and images;
-
TrackMan screenshots or data;
-
Practice recommendations;
-
Scheduling information;
-
Package information; and
-
Administrative communications.
Electronic communications and cloud-based storage involve inherent privacy and security risks. TSR will use commercially reasonable practices but cannot guarantee that electronic communications, third-party platforms, email, text messages, cloud storage, or online systems will be completely secure, uninterrupted, or error-free.
The Client is responsible for providing accurate contact information and for maintaining the security of the Client’s email account, mobile device, and any links or files received.
The Client should promptly notify TSR if materials are delivered to an incorrect recipient or if the Client believes account or contact information has been compromised.
18. OWNERSHIP AND PERMITTED USE OF COACHING MATERIALS
TSR retains all rights in its original coaching methods, report formats, templates, graphics, instructional explanations, drill descriptions, annotations, written materials, videos created by TSR, and other proprietary content.
Subject to full payment, the Client receives a limited, nonexclusive, nontransferable license to use coaching reports, clips, drills, and recommendations provided to the Client for the Client’s personal, noncommercial golf development.
Without TSR’s written permission, the Client may not:
-
Sell, sublicense, or commercially distribute TSR materials;
-
Republish substantial portions as the Client’s own coaching content;
-
Use the materials to train or instruct others for compensation;
-
Remove TSR branding or ownership notices for commercial use; or
-
Make the materials part of a paid course, publication, program, or competing service.
The Client may share personal swing clips or report excerpts privately with the Client’s healthcare provider, golf coach, club fitter, or other advisor for purposes related to the Client’s own development.
19. MINORS
A minor may participate in coaching only with the authorization of the minor’s parent or legal guardian and subject to TSR’s applicable minors policy.
The parent or legal guardian:
-
Consents to the minor’s participation;
-
Confirms authority to provide such consent;
-
Accepts these Coaching Terms on the parent’s or guardian’s own behalf and on behalf of the minor to the fullest extent permitted by law;
-
Is responsible for disclosing relevant medical, behavioral, developmental, mobility, or safety considerations;
-
Consents to instructional video recording and data collection as described in these Coaching Terms; and
-
Is responsible for complying with TSR’s supervision and facility-access requirements.
Unless TSR expressly agrees otherwise in writing, a parent, legal guardian, or other adult meeting TSR’s applicable age and supervision requirements must remain present and available during the minor’s session.
20. RIGHT TO REFUSE, MODIFY, OR TERMINATE SERVICES
TSR may refuse to begin or may immediately modify, suspend, or terminate a coaching session if the Client:
-
Appears impaired or intoxicated;
-
Acts abusively, threateningly, discriminatorily, or disruptively;
-
Engages in unsafe conduct;
-
Refuses to follow safety instructions or facility rules;
-
Misuses equipment;
-
Creates a risk to the Client, coach, another person, or property;
-
Fails to disclose a material physical limitation;
-
Experiences symptoms that create a safety concern;
-
Attempts unauthorized recording or commercial use of the session;
-
Has an unpaid balance; or
-
Otherwise materially violates these Coaching Terms or the General Waiver.
When termination results from Client conduct or a Client-created safety concern, the session may be forfeited without refund or credit.
21. PERSONAL RECORDING OF COACHING SESSIONS
The Client may not audio-record or video-record a coaching session, other than personal swing recordings made with the coach’s knowledge, without the coach’s prior permission.
The Client may not record private conversations involving another Client, TSR employee, contractor, or guest without all legally required consent.
Approved personal recordings may be used only for the Client’s private, noncommercial development unless TSR agrees otherwise in writing.
22. FEES, PAYMENT, REFUNDS, AND CHARGEBACKS
Coaching services must be paid in accordance with the terms displayed at purchase.
Except as expressly stated in these Coaching Terms or required by law:
-
Coaching purchases are non-refundable;
-
Unused services are not redeemable for cash;
-
Late-canceled and missed sessions are forfeited;
-
Completed or partially completed sessions are not refundable; and
-
Dissatisfaction with progress or results does not create a right to a refund.
Before initiating a payment dispute or chargeback, the Client agrees to contact TSR and make a reasonable good-faith effort to resolve the matter directly.
Nothing in this section limits rights that cannot lawfully be waived.
23. THIRD-PARTY TECHNOLOGY
TSR may use third-party systems to provide scheduling, payment processing, simulator operation, data analysis, video storage, file delivery, email, text messaging, or other services.
TSR does not control and cannot guarantee the uninterrupted availability, accuracy, compatibility, security, or continued operation of every third-party platform.
A temporary technology failure does not automatically entitle the Client to a refund when TSR can reasonably provide, complete, reschedule, or replace the affected portion of the service.
24. GOVERNING LAW, VENUE, AND SEVERABILITY
These Coaching Terms will be governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles.
To the fullest extent permitted by law, any legal action arising from or relating to these Coaching Terms or the coaching services must be brought in a state or federal court having jurisdiction in the county in Wisconsin where TSR’s facility is located.
If a provision of these Coaching Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum lawful extent or severed, and the remaining provisions will continue in effect.
25. NO WAIVER; DISCRETIONARY EXCEPTIONS
TSR’s decision not to enforce a provision in one circumstance does not waive TSR’s right to enforce that provision in the future.
Any accommodation, extension, rescheduling exception, weather exception, credit, or refund granted by TSR:
-
Is discretionary;
-
Applies only to the particular circumstances for which it was granted;
-
Does not establish a precedent; and
-
Does not amend these Coaching Terms.
26. ENTIRE AGREEMENT AND ORDER OF DOCUMENTS
These Coaching Terms, the applicable purchase description, and TSR’s General Waiver constitute the agreement governing the Client’s coaching services.
They supersede prior oral discussions or representations concerning cancellation rights, deliverables, coaching outcomes, or other terms addressed here.
No coach, employee, contractor, or representative may modify these Coaching Terms orally. Any material modification must be confirmed in writing by an authorized TSR representative.
If a promotional page, scheduling page, or informal communication conflicts with these Coaching Terms, these Coaching Terms control, except that a written offer expressly granting the Client a more favorable commercial term may be honored by TSR.
27. ELECTRONIC ACCEPTANCE
The Client agrees that electronic acceptance of these Coaching Terms has the same effect as a handwritten signature.
By selecting the acceptance checkbox, clicking the applicable purchase or payment button, electronically signing, or otherwise completing the transaction, the Client confirms that:

The Client has had an opportunity to read these Coaching Terms;
-
The Client understands and voluntarily accepts them;
-
The Client has reviewed or previously accepted TSR’s General Waiver;
-
The Client is at least eighteen years old or is the parent or legal guardian authorized to act for the participating minor;
-
The information provided by the Client is accurate; and
-
The Client intends to be legally bound.
Electronic Acceptance Record: Maintained through TSR’s designated checkout, booking, or electronic-signature system.
