Terms & Conditions

Welcome to The Swing Refinery. These Terms & Conditions (“Terms”) govern your access to and use of The Swing Refinery LLC’s website, indoor golf simulator facility, simulator reservations, leagues, tournaments, private lessons, and related offerings (collectively, the “Services”). By using or purchasing any Service you agree to these Terms. If you do not agree, do not use our Services.

1. Who we are

2. Scope of services

The Swing Refinery LLC operates an indoor golf simulator practice facility offering simulator reservations for practice sessions, leagues, tournaments, and private 1:1 lessons (collectively, “Programs”). We do not offer prepared food or beverages for sale and we do not offer online classes. We may offer merchandise and related retail/shipping services in the future; if and when we do, those services will be subject to these Terms and any additional retail/shipping terms we publish. All Services are provided at our physical location unless otherwise expressly stated.

3. Other legal documents

These Terms are in addition to and incorporate by reference:

If there’s a conflict between these documents, the Liability Waiver and the Cancellation & Refunds Policy govern matters within their scope; otherwise these Terms control.

4. Acceptance of terms; changes

We may modify these Terms at any time. Updated Terms will show the new effective date. Continued use of Services after changes means you accept the updated Terms. If we make material changes, we will attempt to notify you (e.g., email or site notice).

5. Eligibility and minors

  • Minimum age for membership: 18 years.

  • Unaccompanied participation age: 18 years. Minors under 18 may participate only if accompanied by a responsible adult who is at least 21 years old.

  • Parents/guardians must complete any required waivers for minors. By creating an account, booking, or attending, you represent that you meet the eligibility requirements.
     

6. Accounts, bookings & facility rules

  • You may need to create an account to make simulator reservations, join leagues, register for tournaments, or purchase Services. You are responsible for safeguarding your account credentials and for all activity on your account.

  • You agree to provide accurate information and to update it as needed.

  • You must follow posted facility rules, instructor directions, and safety protocols. Failure to comply may result in refusal of service or removal from the facility.

  • We may refuse or suspend accounts, refuse bookings, or cancel orders at our discretion (including for suspected fraud, unsafe behavior, or breach of these Terms).
     

7. Payments, pricing, and taxes

  • Payments are processed by Stripe and may also be processed via third-party payment processors (including any processor used by Trackman’s “Your Golf Booking” or similar services). By purchasing, you authorize us and our processors to charge the payment method you provide.

  • Prices shown include or exclude taxes as specified at checkout; you are responsible for applicable taxes.

8. Memberships, leagues & tournaments (if applicable)

  • Memberships, league registrations, and tournament entries may involve recurring or one-time payments. Recurring payments will continue until canceled in accordance with the Cancellation & Refunds Policy.

  • We may change fees or league/tournament rules with notice. Continued participation after notice constitutes acceptance.
     

9. Private lessons & instructor cancellations

  • Private 1:1 lessons are scheduled by agreement. You must give 48 hours’ notice to cancel or reschedule to avoid being charged.

  • We may substitute instructors or cancel lessons for instructor illness or other reasons. If we cancel, we will make reasonable efforts to reschedule or refund the lesson.
     

10. Facility safety, equipment, food & beverage, and conduct

  • By attending the facility, you represent that you are physically able to participate and that you understand the risks involved with sports activity and simulator equipment. You must follow instructor direction and posted safety rules.

  • Do not operate simulator equipment unless authorized and trained by staff. You are responsible for damage caused by misuse or negligent behavior.

  • Guests are welcome to bring food and beverages, including alcohol. Consumption of alcohol must comply with all applicable laws and facility policies. No person under 21 may consume alcohol on the premises. The Swing Refinery LLC does not provide prepared food or alcoholic beverages for sale, and staff may refuse service to anyone or require a guest to stop consuming alcohol if, in staff’s judgment, the guest is intoxicated or behaving unsafely.

  • Outside food/beverage consumption is otherwise subject to posted facility rules.

  • The Swing Refinery LLC is not responsible for personal property lost, stolen, or damaged on premises.
     

11. Simulator & performance data; recordings, photography & privacy

  • Simulator systems (including third-party systems such as Trackman) may collect swing, shot, and performance data. Collection and use of such data is governed by our Privacy Policy.

  • The facility may record sessions, livestream, or photograph events for safety, coaching, promotional, or educational purposes. Unless you have a prior written agreement to the contrary, by attending you grant The Swing Refinery LLC a non-exclusive, royalty-free, worldwide right to use photos, video, and recorded performance data that include your likeness or performance for promotional, educational, and archival purposes. This use is opt-out as reflected in the Liability Waiver; please notify staff if you wish to opt out.
     

12. User conduct and prohibited activities

You agree not to:

  • Harass, intimidate, or discriminate against others;

  • Interfere with or damage simulator equipment or facility property;

  • Upload or post content that is unlawful, infringing, obscene, defamatory, or otherwise objectionable;

  • Attempt to gain unauthorized access to systems, accounts, or restricted areas;

  • Use the Services for commercial purposes without authorization.

We may remove user content, warn, suspend, or terminate accounts for violations.
 

13. Intellectual property

  • All content on the site and at the facility — text, graphics, logos, images, videos, simulator curricula, training materials, and venue branding — is owned or licensed by The Swing Refinery LLC and protected by intellectual property laws.

  • You may not copy, distribute, modify, or create derivative works without our written permission.

  • If you submit creative content (including swing footage), you grant us a non-exclusive license to display and use that content in connection with the Services; you remain owner of your content unless otherwise agreed.
     

14. Third-party services and links

We may link to third-party sites or integrate third-party services (such as Trackman). We are not responsible for their content or practices. Use third-party services at your own risk and according to their terms.
 

15. Disclaimers

  • THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SWING REFINERY LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, OR NON-INFRINGEMENT.

  • We do not guarantee that participation or use of simulator data will achieve a particular result.
     

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE SWING REFINERY LLC BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING FROM OR RELATED TO THESE TERMS OR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO THE SWING REFINERY LLC IN THE 12 MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, liability is limited to the fullest extent permitted by law.
 

17. Indemnification

You agree to indemnify and hold harmless The Swing Refinery LLC, its officers, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of your use of the Services, violation of these Terms, or infringement of any rights of a third party.
 

18. Termination

We may terminate or suspend your access to all or part of the Services at any time for any reason, including violation of these Terms. Termination does not affect rights and liabilities accrued before termination.
 

19. Governing law and dispute resolution

These Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict of laws principles.

Dispute resolution (hybrid approach): You and The Swing Refinery LLC agree to attempt in good faith to resolve any dispute arising out of or relating to these Terms through informal negotiation. If we cannot resolve the dispute within 30 days, then:

  • If the relief sought is within the jurisdictional limit of the small claims court where you reside or in Milwaukee County, Wisconsin, either party may pursue the claim in small claims court.

  • For all other disputes, the dispute shall be finally resolved by binding arbitration administered by the American Arbitration Association (or a comparable arbitration body if AAA is unavailable) under its Commercial Arbitration Rules. The arbitration shall be held in Milwaukee, Wisconsin. The arbitration award shall be final and binding, and judgment on the award may be entered in any court with jurisdiction. Both parties waive any right to participate in a class or representative action.
     

20. Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, government actions, public health emergencies, strikes). We will make reasonable efforts to resume performance as soon as practicable.
 

21. Accessibility & accommodations

We endeavor to make our facility accessible and to provide reasonable accommodations. Please contact staff in advance to discuss specific needs.
 

22. Notices

We may give legal notice by email or posting on the site. Notices to us should be sent to: swingteam@theswingrefinery.com.
 

23. Severability and waiver

If a court finds any provision invalid or unenforceable, the remaining provisions remain in effect. Failure to enforce any right is not a waiver.
 

24. Entire agreement

These Terms, together with the Privacy Policy, Cancellation & Refunds Policy, and Liability Waiver, constitute the entire agreement between you and The Swing Refinery LLC regarding the Services.
